Judge Asks Appeals Court to Void His Own Decision

A Florida paraphernalia distributor was busted for marijuana possession after police "checking for burglaries" reportedly spoued two pot plants on his terrace, A search of the apartmen t turned up 10grams of herb. Mark Gilbert, owner of Bx>ng City, a Miami headshop, pleaded no contest lo the possession charge, but his lawyer argued the case on grounds of invasion of privacy and the rig hi of a citizen to be left alone in his own home.

After a month of testimony, Judge Joseph Durant of the 11th Judicial District upheld Gilbert's conviction. Nevertheless, he recommended appeal and hoped the Florida Supreme Court would have the "courage and conviction" to reverse his own decision.
